has probably nailed the sequence of events. More importantly, in the context of that sequence ESPN is serving as an adviser to another contracted business partner. Is there potential conflicts of interest? Probably. Is it illegal? Probably not and the proof for either side of the argument would be in specific contract language. If I am a betting man I doubt ESPN lawyers would ever let their executives sign something that would even allow the remote possibility that could even be contested. I imagine the conversation with the ACC or Big 12 goes something like this:

Conferences: we want a provision to protect us against conflicts of interest with your other TV conference partners.

ESPN(the execs and lawyers after a brief chuckle): that is an impossible provision. NO. Do you want the TV network/money or not? You are welcome to go talk to other networks.

Conferences: We'll take it.
