Yes. Ask more from ND for access to the ACC championship game.
Six ACC games is not really enough, I think, if NBC can block the Texas/ND home games somehow from the ACC TV contract. We would have to add the Texas (as an ACC game), plus maybe require one more I think to get it to seven. I know Covid was a weird year, they were willing to do 10 games to get into the ACC championship, so why not for seven?
Also, after thinking about this more, I'd rather require ND to make up the missing games to make this happen to get them up to whatever number the other ACC games play. We should not use percentages in a normal year. If they don't want to play a full ACC schedule, then we should mark some other games of our choosing as "ACC stand in" games that they have to win to win the conference.
We would need rules to keep ND from gaming it to their advantage. Like giving the ACC the right to pick which teams from their OOC schedule to use for this purpose. We would not want them picking Navy for their stand in ACC game(s) every year.
