I am not as familiar with the ACC's bylaws, so the ACC may


just require it for the revenue sports to satisfy NCAA DI Bylaw requirements. FWIW the Patriot League started out allowing its members to offer athletic scholarships in all sports except football. Some time between 2010-13, the Patriot League decided that schools could offer up to 15 athletic scholarships in football. Then some time in the last half of the previous decade, the Patriot League decided that its members could offer up to 60 athletic scholarships in football even though the NCAA placed the cap at 63. Georgetown, a football only member, decided to remain a non-scholarship school.

It is possible the ACC does something similar for all or some of the non-revenue sports with the assumption being that its members will ensure they are compliant with Title IX too. At least it would be the school's responsibility, not the ACC, that whatever decision they make they are compliant with all federal and state laws.

Edit: Also, keep in mind the NCAA and even the conference bylaws are fluid. So the way things are now may not stay the same in a future fiscal year. If things change, then it is possible the NCAA or conference could grandfather schools in for various reasons. If the ACC requires athletic scholarships in wrestling, then the ACC may have grandfathered Duke in as a non-scholarship program in order to have enough teams.
