But yea, that's the jist of it...if higher ed becomes socialized (I hate the political implications of that word...), and one is left with a high dollar 529 plan that essentially cant be used in full, in theory they'd be forced to accrue the 10% penalty along with taxes on the earnings that was distributed and not used for educ. My hunch is, if higher ed was to be socialized, then at a minimum, the 10% pen would go away as others have hinted as well, so it would essentially be like an open ended fund I guess.
Another route that Hokie 360 offered below is the Roth IRA route. Of course, roth's have limitations on contributions...I think zero'd out at $196k filing joint married. So, those living in high cost of living areas like DC, west coast, NYC, etc. that have high associated salary points...it's probably a non starter. But, if a family does have lower AGI income, the Roth IRA is a good option.
Also, Synaesthesia below offered up the idea of using the 529 money to acquire appreciating assets. The example was to buy housing/condo, charge your kid(s) rent which is paid for by the 529 plan...so in essence, the rent paid from the 529 plan helps to acquire the asset. Obviously have to stay on the right side of the law...within market value rents and what not, but it's an interesting idea.
