If your MIL lived in VA I would contact the Clerk of Court where she lived


Not a lawyer, but the Clerk of Court was able to advise me on this in the past.

The Clerk of Court can appoint an administrator if the executor on the will is not able to serve. Possibly could be your wife if her brother does not object, if the two of them the only beneficiary named.
