action. He did the right thing by paying for the window although I doubt he was "negligent" as required to make him liable. He can argue to the judge that she did not claim to inspect the picture window at any time prior so she can't prove anything he did damaged the window and even so, a rock being thrown from an edger isn't negligent or foreseeable. Also she didn't claim he did anything specific to the window when the other glass got broken. Here he can argue that she asked him to edge so she assumed the risk of what happened. This can cut both ways b/c she could argue back that he needed to inspect the area b/f firing up the weedeater. Also, does a "nick" necessitate replacement?

It's a "business" so your homeowners may not cover but, it's allowable to remove a case from small claims if your HO carrier wants to provide him a defense.
