I don't know if you can, but its an intresting philisophical question
Without a higher being, are we then only subject to the rulers of the land that we exist on?
The concept of the creator bestowing the rights of the individual is what elevates the individual above the state, IMO.
ie. I have the right to say what I want b/c God has given me that right. The state can not deprive me of my liberty without due process because God has given me that liberty.
Without the element of the creator as the bestower of our natural rights, by default the government is left as the owner of those rights and could grant them or withhold them as they see fit.
