It would be up to ESPN.

Regarding Notre Dame keeping NBC Contract, I heard Swofford say that in one of the David Teel interviews. ND would be paid football rights by NBC, and ESPN would pay the rest of the ACC. Everything non-football would be business as usual. There is precedence for this. Navy has its own contract for football with CBS outside of the American, but they are in the conference.

Regarding Texas, when DeLoss Dodds inquired about joining the ACC in 2011, John Swofford told them they would have to give up the LHN idea. That was 2011. The LHN didn't get nationwide distribution. Now we have an ACC Network 8 years later. The thought process might be different.

I haven't heard about Texas again, but under ESPN's control, they'll either go SEC or ACC. It could be arranged that the Texas home games against ACC not picked up by ESPN could be shown on LHN, and Texas not get a cut of the ACC Network since they will all be road games. Texas would participate in Tier 1 rights for everything, and also bowl agreements.

This could increase demand of LHN. Remember ESPN now has ESPN+ streaming that can get the games to people with no access to the LHN too. Or Texas could give the LHN up, and put everything on the ACC Network with ESPN paying Texas off the top what the LHN contract calls for. ESPN would have to make the rest of the ACC whole with the Tier 1 rights, but it might work. ESPN has not been willing to do this with the Big XII, but they might with the ACC.
