"competition", the legislature in NY (or maybe it was just NYC) passed an ordinance that ONLY the part of a structure that has a true function can be counted in the overall height. Things were getting out of hand and silly at that point. That is why you see the spire being used as an antenna (not just because it is so tall, it). It has a function, therefore can be included in overall height.

We were told that by our guide at the Freedom Tower (One World Tower) during our tour of the observation deck.. If you haven't done that in NYC, I highly recommend it. We went with some great friends and paid a little extra for the private tour. This guy spent well over an hour walking us around the observation deck, pointing out every last bit of NYC and the different burrows. He went into the history of everything he described, including that little tidbit about the Buildings Heights...Go on a clear day, and you can see for miles upon miles, then eat in the Restaurant up there ..VERY cool, and I'd like to do it again!!
