there. Sounds more to me like a golf community where they were driving three home in a cart with only 2 seats. DUI homicide sounds pretty severe, but since a golf cart is considered a vehicle in most jurisdictions, it's probably a DUI, that lead to a death, so the law is probably being followed correctly.

I have no idea if the driver was driving recklessly, which would certainly shade my opinion.
