You sure about the walk-on element?
I'm no NC congressman or anything and googling doesn't say a whole lot, but what I have found ties residency to *scholarship* athletes. (maybe even just full) For example, the linked bill (which may not have passed and is obviously not even it its final form, but still...)
I guess if it's open to partials, you could play games and someone who is essentially a walk-on could get $100 scholarship or something. Just hard to believe that *all* out-of-state student-athletes are getting the residency benefit.
It definitely can't work as a "waiver" offered as you describe...that would be considered a scholarship. It has to be that the student is actually considered a resident (as the linked doc says).
