Even if it was done on private land, there may be a state law


that require the owner of the land to do certain things or not do certain things in this case for any waterway designated a watershed or other similar environmental designations on the owner's property. For example, I believe VA at one time had a law on its books that required farmers to do their best to limit the amount of manure ended up in waterways, particularly ones designated a watershed, on their property or ran through their property because of the environmental impact it could have on the rest of the waterway that comes after the farmer's land.
