College Football Playoff management committee makes the decision

11 person committee made up of the commissioners of the FBS conferences plus Swarbrick. Any changes before the current contract expires in 2025 has to be unanimous. So if the B1G, PAC or even the Sun Belt doesn't want to expand the playoffs, the expansion is dead.
