I think the reasoning is they aren't ready to regulate the sale of it
so they were going to wait a few years to legalize it. The governor made the argument that if we're going to be legalizing it in the future, we shouldn't be arresting people for it now. So the government isn't ready for full legalization, but they went ahead with it anyway because it seems unfair to be arresting people for something that we've already decided shouldn't be illegal.
