Hard to make the argument that #9 has a legit shot at winning 3 games in a row against the top 8, but the #5 or 6 team may be one that just got upset in their conference title game or something. If you find yourself asking why they don't just do a 6-team playoff then, where the top 2 get a bye, it's because more games means more money for the people running the show.
