Can a university afford to weather the storm


until the investigation and/or any court proceedings are complete before taking any action? UT can expect to have a group of people demanding that UT terminate Jones as HC before the investigation is complete. If UT doesn't want to risk a wrongful termination suit, then it will wait for the investigation to be complete before taking any action. Given the seriousness of the allegation and people's opinions on sexually related crimes, UT is taking a risk that not taking swift and immediate action could tarnish the school's reputation because people could start to view UT as either not taking the allegations seriously and/or not taking a strong stance on the prevention of sexually related crimes.

In most cases an employer will place an employee on administrative leave with/without pay pending the results of the investigation. However, it doesn't seem to be a common or popular move for universities to use with coaches (especially HCs) even though they have no problem using it with the other employees. At least I can only think of a handful of HCs that were placed on administrative leave until the investigation was completed.
