Ty Outlaw was away from his apartment when police smelled pot, entered the apartment, and found marijuana. So he gets charged with misdemeanor possession solely because he’s on the lease even though he wasn’t at home when the alleged smoking occurred.

Is this correct or do I have it wrong?

If correct, I’d expect charges against him to be dropped.
