customer friendly way to start or carry on a conversation. As far as the rest of the legality/contract issue that is why I referred to the "consideration exchanged" in my original post. One more thing on "our attorneys said it was ok". That may or may not be so and it might work until it doesn't. Landscape is littered with attorney's opinions offered verbally based on incomplete or inaccurate information supplied by clients. First thing I would want to know is whether the opinion comes from in house counsel or outside counsel AND whether it was a written or verbal opinion. The further away on the spectrum you move from a written opinion by reputable outside counsel the more likely holes could exist in that argument.
