In the rule, yes. In the process, no.


Discretion/flexibility in the rule allows the committee to consider non-champs.

In the process, if ND or any non-champ is "unequivocally" (undeniably, indisputably, etc.) in the top 4 then they are in. The committee has no discretion to exclude them.

Likewise, if they aren't, they are out. If there is any legitimate debate, e..g., your 4/5 scenario, then the committee does not have the discretion to select the non-champ.
