Which was, of course, created to establish a government loyal to the Union. The Confederate Virginia government had given up its right to object because it was not loyal to the Union. It is a lot more complicated that you suggest with your statement that WV is illegitimate. There are a lot of reasons why WV exists, and the civil war/slavery issues are just a part of it. But, like you said, that is a discussion for some other place.
