It is according to the NCAA DI Bylaws
17.11.6.2 Annual Exemptions. [FBS/FCS]
(d) Additional Football Bowl Subdivision Postseason Game. One postseason game between the winners of two exempted postseason bowl games per Bylaw 17.11.6.2.1-(c). The participants in the two post-season bowl games will be selected by Football Bowl Subdivision conferences and independent institutions.
By requiring an independent to join 1 of the FBS conferences, then you are constraining their trade because you are not giving a school the choice to be an independent or join a conference. Even the NCAA bylaws provide that choice to its members.
Plus, you may be violating another conference's bylaws given that all the FBS Independents are members of at least 1 conference for the other sports they sponsor. Here is a list of all the current DI FBS Independents and their primary conference.
Army - Patriot League
BYU - West Coast
Liberty - Atlantic Sun
New Mexico State - WAC
Notre Dame - ACC
UConn - Big East
UMass - Atlantic 10
As I noted in a previous post, the proposal would require a change in the bylaws. Most likely the one I referenced in this post because the proposal would require the removal of "...and independent institutions" from the bylaw. Good luck getting enough support from the two committees I mentioned in a previous post.
