After 2036, ND is a free agent


If it is forced to join a conference at that time, it is not contractually tied to the ACC and could market itself to the Big Ten for a much bigger payoff than the ACC could provide.

If ND is going to be forced to surrender its independence, the thinking might be to get the most money out of it.

The maxim "We are all whores, the only variable is the price" may come into play if ND has to join a conference or if the ACC issues an ultimatum.

I don't think such an ultimatum you describe would be effective in that scenario.
