Oh I agree it will be a difficult test to pass
Hence why I referenced the SCOTUS ruling because it has opened the door for similar questions to be raised in other states. It could be fascinating (and scary) to see how many people start to raise those questions and what the fallout could be from all of this particularly if people assume that Native Americans "owned" all the land that makes up the US before European settlers arrived here.
Now Native Americans did sell the land which later became NYC and Hawai'i may have had to make some concessions when it became a territory and later a state. However, I can't think of any other potential examples where Native Americans either sold land or willingly gave land away via a treaty.
