Pro league or non NCAA, courts would see it as an attempt to circumvent an existing contract.

Another problem that would arise would be labor laws. If there is a "salary cap" in this new conference, the only way that can be done is with a comprehensive labor agreement, and the only way that you can have that is if there is a union in place. Most of the states that would have teams in this new conference ban public sector unions.
