Even though what you say is true, it does not have to be the case

with the NCAA. Heck the NCAA could be structured so that its Commissioner can even have term limits to help maintain independence and separation of power.

My point is that the way the NCAA is currently structured may not work anymore. Even if you remove the NCAA, the schools will end up replacing the association with a new association that most likely will be exactly like the NCAA. Heck it could even have the same structure.
