I would be very careful with the next steps
If the documented policy is not being followed, that is in your favor. But this is a private school so they may not be as bound to processes as a state school. You have to make sure that you know every letter of the documented policy. There could be an out for them to go off script that is buried or not obvious.
Also, what is the ultimate goal here? Once you go down a litigation path it could be hard to keep a good relationship with the other party (the university in this case). And you have to think about their friends and connections and the potential impact on future others jobs at other schools when the people talk. Not to say that you shouldn't do this, just be aware of all the potential impacts beyond the immediate tenure issue.
